Although a Chapter 7 filing you may be able to retain most or all of your assets, you will be able to discharge almost all debts entirely. Eligiblity For Chapter 7

In order to file for Chapter 7 Bankruptcy, you must be able to pass the “means test.” According to Federal Law, if your household income is less than the median household income in your state, you will be able to file for Chapter 7 relief. However, if your house hold income is greater than the median household income, under certain circumstances you may still be able to Chapter 7, but that is not always the case.

Almost all debts can be discharge except for certain ones like student loans (except for showing undue hardship-which is very difficult to do). To be eligible for Bankruptcy protection, you must pay the means test. The means test will look at your family size and then your income. There are times where your income can be higher than the means test. Then there a second test where it considers how much debt you have with respect to your income to qualify for Chapter 7 benefits. Liquidation

In Chapter 7 bankruptcy, some of your property may be liquidated (sold) to pay your creditors.

Chapter 7 will discharge you of unsecured debt such as:

  • Medical Bills
  • Wage garnishments
  • Judgments
  • Credit Card Debts
  • Utility Bills
  • Certain Tax Debts

Another benefit for filing a Chapter 7 Bankruptcy is that you will immediately receive an automatic stay. When the automatic stay is in place, creditors are prohibited from calling, writing or taking other action to collect debt. If you do not qualify for Chapter 7, you will be eligible to file for Chapter 13 Bankruptcy.
