It is critical to speak with me to determine whether you receive or pay child support. Child Support is for the best interest of the child because the Maryland Legislature intent to have the non-custodial parent pay the custodial parent child support, so that the custodial parent can properly care for the children meaning providing clothes, food, shelter, transportation, etc. It is in the Maryland public policy that if one of the parent’s income increases substantially that the income should benefit the children, but the custodial parent must request from the Court that the non-custodial parent income have changed substantially in order for the Court to increase the child support payment.

In order to determine child support, the Court would look at the parents’ income. The Custody arrangement they have between both parties where the custodial parent has sole physical custody or shared physical custody and whether the non-custodial parent has sole physical custody or shared physical custody. After a number of overnights with the non-custodial parents have with the children, this will determine whether the non-custodial parent has sole physical custody or shared physical custody meaning whether the how nights the children sleep over with the non-custodial parent. Also, the Court will see who pays the health insurance as well as work related day care. In additional, if there are additional transportation expenses the custodial parents has for the children.

There are additional cost a parent accrue in order to raise the child like unexpected medical expenses where the non-custodial parent is liable for a certain amount under Maryland Law. Maryland’s Child Support Guidelines

Maryland law offers specific guidelines relating to the amount of child support that will be paid. The guidelines act as a formula and provide a clear picture of the amount of support a parent is likely to pay based on a number of factors, including the income of each parent, the custody arrangements and the visitation schedule.

The guidelines, however, are not set in stone. In limited circumstances where the child support amount is unjust or inappropriate, the court may deviate from the guidelines. Additionally, extra costs, such as day care, extraordinary medical costs or other special costs, may be divided proportionally between the parents, based on their incomes.
